Review of the Council's Constitution

Extract from the proceedings of the Policy & Resources Committee meeting held on the 30th April 2020 (to follow), together with a report of the Executive Lead Officer for Strategy, Governance & Law

Minutes:

10.1         The Mayor stated that the next item concerned the review of the council’s constitution and recommendations of the Policy & Resources Committee and invited Councillor Platts to move the report.

 

10.2         Councillor Platts formally moved the recommendations.

 

10.3         Councillor Moonan formally seconded the recommendations.

 

10.4         Councillor Fishleigh stated that she wished to move an amendment.

 

10.5         The Mayor noted the request and stated that he would adjourn the meeting to take advice from officers. The meeting was adjourned at 6.15pm.

 

10.6         The Mayor reconvened the meeting at 6.20pm and stated that although it was not usual practice to take an amendment at such a late stage, he would allow it on this occasion and asked Councillor Fishleigh to put her amendment forward.

 

10.7         Councillor Fishleigh proposed that the report should be deferred to allow for a period of public consultation on the changes being put forward.

 

10.8         Councillor Janio formally seconded the amendment.

 

10.9         The Mayor noted that the amendment had been moved and therefore put it to the vote.

 

10.10      Councillor Platts confirmed that the Labour Group were against the amendment and the Labour Group confirmed that they were voting against the amendment.

 

10.11      Councillor Mac Cafferty confirmed that the Green Group were against the amendment and the Green Group confirmed that they were voting against the amendment.

 

10.12      Councillor Bell confirmed that the Conservative Group were in against the amendment and the Conservative Group confirmed that they were voting against the amendment.

 

10.13      Councillor Fishleigh confirmed that she was voting for the amendment.

 

10.14      Councillor Janio confirmed that he wished to abstain from voting on the amendment.

 

10.15      The Mayor confirmed that the amendment had been lost.

 

10.16      The Mayor then put the recommendations as listed in the report to the vote.

 

10.17      Councillor Platts confirmed that the Labour Group were in favour of the recommendations and the Labour Group confirmed that they were voting for the recommendations.

 

10.18      Councillor Mac Cafferty confirmed that the Green Group were in favour of the recommendations and the Green Group confirmed that they were voting for the recommendations.

 

10.19      Councillor Bell confirmed that the Conservative Group were in favour on the recommendations and the Conservative Group confirmed that they were voting for the recommendations.

 

10.20      Councillor Fishleigh confirmed that she was voting against the recommendations.

 

10.21      Councillor Janio confirmed that he wished to abstain from voting on the recommendations.

 

10.22      The Mayor confirmed that the recommendations as listed in the report had been agreed.

 

10.23      RESOLVED:

 

(1)      That the proposed changes to delegations in respect of the Environment, Transport & Sustainability Committee indicated in paragraphs 4.5 – 4.6 of the report be agreed;

 

(2)      That the proposal at para 4.11 and Appendix 2 to the report to amend the Council Procedure Rules at Part 3.2 of the Council’s Constitution in respect of arrangements for Member amendments be agreed;

 

(3)      That the proposal at para 4.12 and Appendix 3 to the report for amendments to Part 8.4 –Guidance for Members and Officers serving on Outside Bodies be agreed;

 

(4)      That the Chief Executive and Monitoring Officer be authorised to take all steps necessary or incidental to the implementation of the changes agreed by the Policy & Resources Committee and by Full Council, and that the Monitoring Officer be authorised to amend and re-publish the Council’s constitutional documents to incorporate the changes;

 

(5)      That the proposed changes come into force immediately following their approval by Policy & Resources Committee or adoption by Full Council, as appropriate.
